SRC, LLC is a Michigan limited liability company doing business as SRC Refrigeration, (“Company,” “us,” “we,” or “our”). The Company manufactures custom walk-in coolers and freezers and related products and parts (collectively, “SRC Products”). This Privacy Policy explains what personal data we collect through our website, and domains accessible through, https://srcrefrigeration.com and https://motorcitygrowsystems.com (collectively, the “Site”), how we use and disclose that information, and your choices and rights related to our personal data processing practices. This Privacy Policy forms part of our Terms of Use (“Terms”). By using our SRC Products and Site, you agree to the collection, use, and disclosure of your Personal Information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access or use our Site.
When we use the term “personal data” in this Privacy Policy we mean any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as otherwise defined by applicable law. “Personal Data” or “Personal Information or “Personally Identifiable Information” shall be interchangeable terms and have the meaning assigned by the applicable state consumer data privacy law. You may have various privacy rights concerning the information we process about you depending upon the applicable law of the state in which you reside.

1.1. Our Responsibilities. For both visitors to our Site, we act as the “data controller” of personal data. This means we determine how and why your personal data is processed.

We work with third-party tracking services that use cookies to collect information about our users only if the user opts in to the tracking functions. If you opt into the tracking functions, then trackers may automatically collect information about your use of the site and may disclose that information to our third party partners. 2.2 Provided by Visitors. The Site may allow you to provide personal data to us voluntarily. For example, you may communicate or otherwise submit product inquires to us and we will keep copies of such communications, including your personal data such as name and contact information, for our records.
2.3 Provided by Third Parties. We collect personal data from third parties to whom you give permission to share your personal data with us or where that personal data is publicly available online. Examples of the types of third-party sources we obtain information from include our business partners and business contact databases. Most commonly the information provided will include your name and contact information. The information may also include the company you work for, information about your use of our SRC Products, or that you have an interest in using our SRC Products.
2.4 Analytics Technologies. We use analytics tools, such as those offered by Google Analytics, Google Tag Manager, Termly, MS Azure, Salesforce, WP Engine, MS Clarity, and Attributor.io for internal purposes only, to measure visitors’ engagement and for improving our Site based on measurement of certain usage data. In Brief: Some types of personal data are very sensitive and should not be shared with us. Do not share this information with us.
3.1 Sensitive Personal Data. We do not request or intentionally collect any data classified as Sensitive Personal Data under applicable law, such as government-issued identification numbers or health, genetic, precise geolocation, or religious information.
3.2 Children’s Personal Data. Our site is intended only for business-to-business communications and is not a consumer site. We do not intentionally collect any personal data from minors, including children under the age of 16, unless affirmative consent is received under applicable law.

We will only send you marketing information via email and text message if you are our customer, otherwise consent to us doing so, or otherwise opt-in to receive marketing emails from us. (i) Purpose of Collection and Use: Processing Job Applications.
(ii) Examples: We may use Silkroad as a service provider to help us process job applications.
6.2 Business Transactions. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your personal data and other information may be transferred to a successor or affiliate as part of that transaction.
6.3 Legal Requirements. We may disclose personal data in order to: (a) comply with our legal obligations, (b) detect, prevent, or otherwise address fraud, security or technical issues, (c) enforce applicable policies, including investigation of potential violations, or (d) protect against harm to the rights, property or safety of our users, the public, or ourselves.
6.4 Partners and Affiliates. We may disclose any information we receive to our partners, corporate affiliates, parents, or subsidiaries for any purpose described in this Privacy Policy.
7.1 Data Retention. We retain your personal data for as long as necessary to provide you services and in accordance with our data retention schedule. We may retain your personal information for longer if it is necessary to comply with our legal or reporting obligations, resolve disputes, enforce contracts, address other legitimate business needs, or as permitted or required by applicable law. We may also retain your personal data in a deidentified or aggregated form so that it can no longer be associated with you. 7.2 Global Privacy Practices. If you are using the Site from a country outside the United States, your personal data may be transferred for processing from your current location to our offices and servers and our authorized third-party service providers located globally, including the United States. Other countries may have data protection laws less stringent or otherwise different from the laws in effect in the country in which you are located. Where your data is transferred from the European Economic Area (EEA) or the United Kingdom (UK), and the country to which it is transferred is not subject to an adequacy decision by the EU Commission, or UK equivalent, as applicable, we rely on one of the following legal mechanisms: EU Commission approved Standard Contractual Clauses or your consent. 7.3 Your Choices about how we Use and Disclose Your Information.
(a) Emails. You have the opportunity to opt-out of email messages from SRC by using the opt-out link included in the footer of the message. If you believe that you have received an unsolicited commercial email from us, you may report it to us at privacy@src.us.
(b) Disable Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our website may then be inaccessible or not function properly.
(c) State Privacy Rights. Depending on the applicable law of the state in which you reside, you may have various privacy rights concerning the information we process about you, including but not limited to:
(i) Right to withdraw consent: Know/Access. You may have the right to withdraw your consent to the processing of request that we disclose the following to you upon receipt of your verifiable consumer request:
(A) The categories of personal data we have collected about you;
(B) The categories of sources from which we collected that data;
(C) The business or commercial purposes for collecting, selling, or sharing that data;
(D) The categories of personal data we sold or disclosed for a business purpose;
(E) The categories of third parties to whom we disclosed that data;

If you previously provided us your personal data and that data is available in a digital format, you may have the right to obtain a copy of the data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another person without hindrance.
(ii) Right to Delete. You may have the right to request that we delete your personal data from our records, subject to certain exceptions. Upon receipt of a verifiable consumer request, and as required by applicable law, we will delete and direct any service providers to delete your personal data.
(iii) Right to Verify. Requests for access to or erasure of personal data are subject to our ability to reasonably verify your identity in light of the information requested
(iv) Right to Correct. You have the right, subject to certain limitations, to request that we correct any inaccurate personal information we maintain about you. Upon receipt of a verifiable consumer request, and as required by applicable law, we will take appropriate steps to respond to your request.
(v) Right to Opt-Out of Selling, Sharing, Targeted Advertising, and/or Profiling. We engage in common marketing and advertising practices to provide more relevant content and ads to users of our websites and services. Certain of these practices may involve the “selling” or “sharing” of personal data, or the use of such data for “targeted advertising” or “profiling,” as those terms are defined under applicable law. We do not sell personal data under the more commonly understood meaning of that word – i.e., providing it to third parties in exchange for money. Nor do we have actual knowledge of selling or sharing personal data of minors under the age of 16. We also treat Global Privacy Control browser signals as opt-out of sale/sharing/targeted advertising/profiling requests in a “frictionless manner” (as defined under applicable law).
(vi) Right to Consent or Limit Use or Disclosure of Sensitive Personal Data. You may have the right, subject to certain exceptions, to consent to or request limitations on the use and disclosure of your sensitive personal data, as that term is defined under applicable law. We do not use sensitive personal data to infer characteristics about data subjects nor for purposes other than those set forth in Section 7027(m) of the regulations implementing the CCPA, as applicable. Upon receipt of a verifiable consumer request, and as required by applicable law, we will take appropriate steps to respond to your request. Additionally, where required by applicable law, we will process your sensitive personal data only with your consent.
(vii) Right Against Discrimination. You have the right not to be discriminated against for exercising any of the rights described in this section. For example, we generally will not provide you a different level or quality of goods or services if you exercise these rights.
The exact scope of these rights may vary by state. If you wish to exercise any of these rights, submit a request, or appeal a decision regarding a consumer rights request, please see “How Can You Exercise Your Privacy Rights?” section below. If you make a rights request, we may be required to respond to you within one month. If you choose not to provide us with the personal data we collect, some features of our Services may not work as intended.
7.4 International Personal Data Transfers.
If you choose to use our SRC Products and Site from other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal data outside of those regions to the U.S. for storage and processing.
By providing any information, including personal data, on or to our Refrigeration Products and Site, you consent to such international transfer, storage, and processing.
7.5 How Can You Exercise Your Privacy Rights?

You will need to describe your request with sufficient detail to allow us to review, understand, assess, and respond to it.
Verification. We reserve the right to only respond to verifiable consumer requests. A verifiable consumer request is one made by:
To verify your identity, we may ask you to verify personal data we already have on file for you. If we cannot verify your identity from the data we have on file, we may request additional data from you, which we will only use to verify your identity, and for security or fraud-prevention purposes. Making a verifiable consumer request does not require you to create an account with us.
Authorized Agents. You may authorize a natural person or business entity to act on your behalf with respect to your rights under this section. Unless you have provided the authorized agent with a qualifying power of attorney, you must provide your authorized agent written permission, signed by you, to act on your behalf and verify the authorized agent’s identity with us. We reserve the right to deny requests from persons or businesses claiming to be authorized agents that do not submit sufficient proof of their authorization.
We may not be able to respond to your request or provide you with personal data if we cannot verify your identity or authority to make the request and confirm the personal data relates to you.
Our Response. You may have the right, subject to applicable law, to submit up to two (2) requests per year free of charge. We reserve the right to charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded. If we determine that a request warrants a fee, we will attempt to notify you as to why we made that decision and provide a cost estimate before completing your request. We will endeavor to respond to a verifiable consumer request within forty-five (45) calendar days of receipt, but we may require an extension of up to forty-five (45) additional calendar days to respond and we will notify you of the need for the extension.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. In the event we deny your request, in whole or in part, we will explain the bases for that denial.
Appeal of Our Response. In the event you believe we have erroneously denied your request, in full or in part, you may, within 60 days of receipt of that denial, submit an appeal. In your appeal submission, please explain why you believe our decision to deny your request was incorrect and please provide any additional information you believe we should consider in connection with your appeal. Within 60 days of receipt of your appeal, we will advise you in writing of any action we have taken, or refrained from taking, in response to your appeal, along with an explanation of why we have taken, or refrained from taking, such action.
This section is only applicable to residents of California.
Shine the Light. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal data by us to third parties for the third parties’ direct marketing purposes. Such requests must be submitted to us in accordance with the instructions in the How You Can Exercise Your Privacy Rights? section of this Policy. Please mention when contacting us that you are making a “California Shine the Light” inquiry. Within 30 days of receiving such a request, we will provide a list of the categories of personal data disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted other than in accordance with the instructions specified in this paragraph.
Eraser Law. If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, California law permits you to request and obtain removal of content or information you have publicly posted. You may submit your request using the contact information at the end of this Policy. Please be aware that such request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
This section is only applicable to residents of Nevada. Under Nevada law, Nevada residents may opt out of the sale of certain “covered information” collected by operators of websites or online services. We currently do not sell covered information, as “sale” is defined by such law, and do not have plans to do so. In accordance with Nevada law, you may submit to us a verified request instructing us not to sell your covered information. Such requests can be submitted in accordance with the instructions provided in the Contact Us section of this Policy.

We assume no responsibility or liability for the actions of such third parties with respect to their collection or use of your information. 11.1 Responsibilities. We take reasonable administrative and technical steps to protect your personal data from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. We protect the security of your personal data during transmission by using Secure Sockets Layer (SSL) software or other encryption technology, which encrypts personal data you input. Wherever appropriate, we obfuscate and/or encrypt personal data in our systems and/or during information transfer. However, no method of transmission over the internet is 100% secure and we cannot absolutely guarantee the security of your personal data.
